SeaVelopTM Limited Warranty and Limitation on Liability
What is Covered
SeaVelopTM products carry a limited, non-transferable warranty (“Warranty”) covering defects in materials and workmanship, subject to the exclusions and limitations below.
Warranty Exclusions (What the Warranty Does Not Cover)
The Warranty does not cover corrosion, oxidation, fading, discoloration, scratches, dents, chips, gouges, or other cosmetic marks or damage unless it results in the loss of performance of the product, structural integrity of the product, or a failure of the product. The Warranty does not cover damage from tampering, disassembly, modification, misuse, accident, abuse, neglect, improper installation, misapplication, alteration, disaster, improper care/maintenance, or normal and reasonable wear and tear.
Warranty Coverage Duration
The Warranty lasts for one (1) year from the date of original purchase of this product from SeaVelop, and is not extendable except as set forth herein.
Who is Covered
The Warranty extends only to the original retail purchaser of the product. The original retail purchaser must purchase the product directly from SeaVelop in order for this Warranty to apply. SeaVelop products purchased from sources other than SeaVelop are not covered under the Warranty. The Warranty is not transferable to subsequent owners.
How to Obtain Warranty Services
Contact SeaVelop directly at warranty@seavelop.com for warranty support. Do not ship any products to SeaVelop unless you have contacted SeaVelop and received return instructions, including a Return Merchandise Authority (RMA) number. SeaVelop will not be responsible for product shipped to SeaVelop without an RMA.
A purchase receipt showing date of purchase and name of original purchaser of the SeaVelop product must be provided. If no purchase receipt is provided, no warranty coverage will be provided.
Any claim under the Warranty must include an accurate description of the problem or visual evidence of the defective part.
What SeaVelop will do
SeaVelop products covered under the Warranty will be replaced or repaired at the sole discretion of SeaVelop at no cost for the warranted component. Any acceptance of product by SeaVelop for repair or replacement shall not be deemed an admission that the product is in violation of Warranty or is defective.
The repair or replacement of product(s), in SeaVelop’s sole discretion, shall fulfill all SeaVelop’s warranty obligations under the Warranty.
SeaVelop shall not be liable for any delay or default in performance under the Warranty caused by any event or contingency beyond the control of SeaVelop, including, without limitation, acts of God, war, governmental restrictions or restraints, pandemic, labor strikes, fire, floods, transportation delays or reduced supply of materials.
In the event of replacement of a warranted product, this Warranty shall continue in effect for: 1) the remainder of the original one-year Warranty period; or 2) ninety (90) days of shipment of the replacement product from SeaVelop, whichever is longer.
Shipping and Handling:
Any expenses incurred in the removal, replacement, shipping, delivery, or transportation of the product are not covered by the Warranty, and will not be paid by SeaVelop.
Voiding the Warranty
Any modifications or alterations to a SeaVelop product will void the Warranty. Substitution of non-SeaVelop component(s) into a SeaVelop product may also void the Warranty, in SeaVelop’s sole discretion.
WARRANTY DISCLAIMERS
TO THE MAXIMUM EXTENT ALLOWED BY LAW, ALL STATUTORY, EXPRESSED OR IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE FULLY DISCLAIMED BY SEAVELOP.
LIMITATION ON LIABILITY
SEAVELOP, ITS OWNERS, DIRECTORS, AND OFFICERS, SHALL NOT BE LIABLE FOR ANY INCIDENTAL, SPECIAL AND/OR CONSEQUENTIAL DAMAGES ARISING FROM ANY CLAIM, JUDGMENT, ORDER, DISPUTE, SETTLEMENT OR ACCOMODATION RELATED TO, OR ARISING FROM, THIS WARRANTY, OR THE PURCHASE, OWNERSHIP, MAINTENANCE OR USE OF SEAVELOP PRODUCTS (“CLAIM(S)”). SEAVELOP’S TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT BY THE ORIGINAL RETAIL PURCHASER. Some states and/or countries do not allow exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you, SeaVelop does not authorize any person or representative to make or assume for SeaVelop any obligation or liability in connection with the sale or warranty repair of any SeaVelop product.
